By accessing our website, purchasing products, submitting items for sale or consignment, or otherwise engaging with Luxe Junky, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.

1. Independent Luxury Resale Business

Luxe Junky is an independent luxury resale company specializing in authenticated pre-owned and collectible luxury handbags, with a particular focus on Hermès Birkin and Kelly bags.

Luxe Junky is not affiliated with, endorsed by, authorized by, or associated with any designer brand, including Hermès or any other luxury house referenced on this website. All trademarks, brand names, logos, and copyrights remain the property of their respective owners.

2. Eligibility to Use Our Services

By using our services, you represent and warrant that:

•       You are at least eighteen (18) years old;

•       You have the legal authority to enter into binding agreements;

•       All information you provide to Luxe Junky is truthful, accurate, and current;

•       You will not use our services for fraudulent, unlawful, or abusive purposes.

Luxe Junky reserves the right to refuse service, cancel transactions, limit purchases, suspend accounts, or terminate access to our services at any time and for any reason in our sole discretion.

3. Sanctions and Restricted Jurisdictions

Luxe Junky complies with all applicable economic and trade sanctions, including those administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC). We do not sell, ship, or otherwise provide goods to, or transact with, any individual or entity located in, ordinarily resident in, or acting on behalf of a comprehensively sanctioned jurisdiction, including Cuba, Iran, North Korea, Syria, Russia, Belarus, and the Crimea, Luhansk, and Donetsk regions of Ukraine.

We also do not transact with any person or entity identified on applicable sanctions or restricted-party lists, including OFAC’s Specially Designated Nationals and Blocked Persons (SDN) List. By purchasing from Luxe Junky, you represent and warrant that you are not located in, a national or resident of, or acting on behalf of any such jurisdiction or listed person, and that you will not export or re-export any item to a prohibited destination.

Luxe Junky reserves the right to screen orders and to refuse, cancel, or unwind any transaction that would violate applicable sanctions laws.

4. Product Descriptions & Condition Disclosure

All items sold by Luxe Junky are pre-owned, vintage, collectible, consigned, or resale luxury handbags unless expressly stated otherwise.

Because of the nature of luxury resale products, items may display signs of age, wear, storage, handling, or prior ownership, including but not limited to:

•       Patina

•       Scratches

•       Creasing

•       Softening

•       Hardware wear

•       Oxidation

•       Surface marks

•       Interior wear

•       Odors

•       Material variations

•       Color variations

•       Stitching inconsistencies

•       Natural aging

Condition assessments are subjective opinions and may vary from person to person.

Product photographs are provided for reference purposes only. Actual colors, textures, and appearance may vary depending on lighting conditions, monitor settings, photography, and device displays.

Measurements provided by Luxe Junky are approximate and not guaranteed to be exact.

Buyers are solely responsible for reviewing all item photographs, descriptions, disclosures, measurements, and condition notes prior to purchase.

Additional photographs or videos may be requested before purchase whenever available.

5. Authenticity Policy

Luxe Junky carefully reviews and evaluates items represented as authentic using internal expertise, industry knowledge, research, and third-party authentication resources where applicable.

However, authentication is an opinion based on currently available information and industry practices and may vary among authenticators, marketplaces, brands, or experts.

Designer brands, including Hermès, are not affiliated with Luxe Junky and do not authenticate items sold by Luxe Junky.

Any disagreement from a third-party authenticator, resale platform, marketplace, or expert opinion shall not automatically invalidate a transaction or create an obligation for Luxe Junky to issue a refund, return, exchange, or cancellation.

Luxe Junky reserves the sole right to determine the authenticity status of any item sold through its platform.

6. ALL SALES FINAL

All sales made by Luxe Junky or any affiliated entity are final.

By purchasing any item from Luxe Junky, the purchaser expressly acknowledges and agrees that all products are sold on a strict “AS IS,” “WHERE IS,” and “WITH ALL FAULTS” basis, without return privileges, refunds, exchanges, cancellations, or store credit, except where prohibited by applicable law.

Due to the exclusive, collectible, pre-owned, vintage, and investment-grade nature of the luxury handbags sold by Luxe Junky, all transactions are irrevocable once payment has been submitted and accepted.

No refunds, returns, exchanges, cancellations, credits, or adjustments will be granted for any reason, including but not limited to:

•       Change of mind or buyer’s remorse

•       Odor, texture, color, or material expectations

•       Natural wear, aging, patina, softening, stretching, oxidation, or deterioration

•       Minor imperfections, handling marks, or characteristics consistent with pre-owned luxury goods

•       Subjective assessments of condition

•       Failure to review listing descriptions, measurements, or photographs

•       Delays caused by shipping carriers

•       Market fluctuations or resale value changes

•       Gift purchases or mistaken purchases

•       Claims regarding future repair costs or maintenance needs

7. Buyer Responsibility & Inspection

The purchaser is solely responsible for reviewing all photographs, descriptions, measurements, disclosures, and item details prior to completing a purchase.

By completing a transaction, the purchaser acknowledges that they have independently evaluated the item and accepted its condition in full.

Upon delivery, purchasers are responsible for immediately inspecting all items received.

Any claim alleging receipt of an incorrect item must be submitted in writing within forty-eight (48) hours of confirmed delivery.

Failure to provide notice within this period constitutes full acceptance of the item and waiver of related claims.

8. Shipping, Delivery & Risk of Loss

Luxe Junky reserves the right to select the shipping carrier and delivery method for all shipments.

Risk of loss and title transfer to the purchaser upon confirmed delivery by the shipping carrier to the address provided at checkout.

Once tracking reflects delivery confirmation, Luxe Junky shall have no responsibility or liability for loss, theft, damage, package tampering, or misdelivery.

Customers may not reroute packages after shipment. Any rerouting request made directly with the carrier transfers all shipping risk to the purchaser.

Signature confirmation is required for all transactions.

Shipping timelines are estimates only and are not guaranteed.

Luxe Junky shall not be liable for carrier delays, weather events, customs delays, lost packages, theft, or events outside of its control.

9. Chargebacks & Payment Disputes

By completing a purchase, the purchaser agrees not to initiate or pursue any credit card chargeback, payment reversal, bank dispute, or payment processor claim inconsistent with these Terms.

In the event of a payment dispute or chargeback attempt, Luxe Junky reserves the right to provide all relevant evidence to financial institutions, payment processors, law enforcement, and dispute-resolution entities, including but not limited to:

•       Invoices

•       Emails

•       Text communications

•       Tracking confirmations

•       Delivery confirmations

•       Signatures

•       Authentication records

•       IP address logs

•       Fraud-prevention data

•       Customer acknowledgments

•       Product photographs and videos

The purchaser agrees to reimburse Luxe Junky for any costs, losses, fees, chargeback penalties, attorney’s fees, collection costs, or related expenses incurred in responding to improper disputes or fraudulent claims to the fullest extent permitted by law.

Fraudulent disputes may be referred to law enforcement or civil legal counsel.

10. Consignment & Seller Submissions

Individuals submitting items to Luxe Junky for purchase, trade, or consignment represent and warrant that:

•       They are the lawful owner of the item;

•       The item is authentic;

•       The item is not counterfeit, stolen, or subject to liens or legal disputes;

•       They have full authority to transfer ownership.

Luxe Junky reserves the right to reject any item for any reason in its sole discretion.

Any quote, estimate, or offer provided prior to inspection is non-binding and subject to revision after authentication and condition review.

11. Intellectual Property

All content on the Luxe Junky website, including but not limited to photographs, logos, graphics, text, branding, product descriptions, videos, and design elements, is owned by or licensed to Luxe Junky and protected by applicable intellectual property laws.

No content may be copied, reproduced, republished, distributed, modified, or commercially exploited without prior written consent from Luxe Junky.

12. Limitation of Liability

To the fullest extent permitted by law, Luxe Junky shall not be liable for any indirect, incidental, consequential, punitive, exemplary, or special damages arising from or related to:

•       Any transaction;

•       Use or inability to use products;

•       Shipping issues;

•       Authentication disputes;

•       Resale market fluctuations;

•       Loss of profits;

•       Emotional distress;

•       Loss of business opportunity;

•       Third-party actions.

Luxe Junky’s total maximum liability arising from any claim shall not exceed the original purchase price actually paid for the item giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Luxe Junky, its owners, employees, affiliates, contractors, representatives, successors, and agents from and against any claims, damages, liabilities, losses, costs, expenses, or attorney’s fees arising from:

•       Your breach of these Terms;

•       Your misuse of our services;

•       Your violation of any law;

•       Any fraudulent or unlawful activity associated with your account or transactions.

14. Governing Law & Venue

These Terms and all transactions with Luxe Junky shall be governed by and interpreted under the laws of the State of Florida, without regard to conflict-of-law principles.

The purchaser agrees that any dispute, claim, or legal proceeding arising out of or relating to any transaction with Luxe Junky shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and the purchaser expressly consents to the jurisdiction and venue of such courts.

15. Modification of Terms

Luxe Junky reserves the right to modify, update, or revise these Terms at any time without prior notice.

Any modifications become effective immediately upon posting to the website.

Continued use of Luxe Junky’s services after changes are posted constitutes acceptance of the revised Terms.

16. Acceptance of Terms

By purchasing from Luxe Junky, submitting items to Luxe Junky, accessing our website, or otherwise using our services, you acknowledge that you have read, understood, and voluntarily agreed to these Terms in their entirety.
